Am I wrong Sun Going GPL?

AP according to Lycos News this morning has a report on Sun releasing Java as GPLed. The reason why I dsoubt the report is that GPL 3 is not fully finalized as of yet and GPLv3 tends to not like software patents in tis recent draft form.
