(SH) - Liberals by and large believe in a living Constitution, which is to say, a dead Constitution, and that's the chief fact to keep in mind during Senate hearings on John Roberts next week, not the Gulf Coast hurricane that is being blamed on the president by his clangorous critics. True, the critics don't precisely say the president caused the hurricane, but you do get the sense he is being held responsible because it happened on his watch. Listen, for instance, to those arguing that the war in Iraq somehow nullified the possibility of effective response or that racists in the administration did not act more quickly because the victims were largely black. No less an expert than actor Sean Penn says George W. Bush is guilty of criminal negligence.
